These Terms and Conditions were last revised on August 26, 2026.
Welcome to FikerLearn! These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Abel Solomon Asfaw ("we," "us," or "our"), concerning your access to and use of the FikerLearn website, Progressive Web App (PWA), and mobile applications (collectively, the "Service").
Our primary place of operations is located at Abado Ena Tafou 20/21, Addis Ababa, Ethiopia (Postal Code 1000). By accessing or using the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, INCLUDING THE MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 12, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY.
FikerLearn is a digital educational practice center and learning simulator designed to assist students in preparing for national examinations (including Ministry Exams and ESSLCE). The Service provides access to curriculum-aligned mock exams, subject flashcards, real-time multiplayer learning arenas, and interactive AI study companions (e.g. Mr. Abel, Dr. Aster, Mr. Solomon). The study materials are tailored for students in Grades 6, 7, 8, 9, 10, 11, and 12 under the Ethiopian educational curriculum.
We grant you a non-exclusive, non-transferable, revocable, personal, and non-commercial license to access the study materials solely for your individual educational preparation.
The Service is designed to be accessible to K-12 students. If you are a minor under the age of 18 (which includes Grade 6, 7, and 8 students), you must obtain explicit permission from your parent or legal guardian to register an account and use our Service.
By allowing a minor to use the Service, the parent or guardian agrees to be bound by these Terms and our Privacy Policy and is responsible for supervising the minor's activity. If we discover that a minor under the age of 13 has registered without verified parental consent, we will delete the account and associated data in accordance with applicable laws (including COPPA and child safety regulations).
To unlock study history tracking, progress statistics, and multiplayer arenas, you must register for an account using a valid email address and password, or through authorized third-party authentication providers (such as Google Sign-In).
You are responsible for keeping your account credentials confidential. You agree to notify us immediately of any unauthorized use of your account. You can modify your username or update your password at any time via your Profile Settings.
Account Deletion (Self-Service): You have the absolute right to delete your account at any time. In compliance with Apple App Store Guideline 5.1.1(v) and global data privacy standards, you can perform this directly within the app by navigating to Profile Settings > Danger Zone > Delete My Account. Upon confirmation, your user profile, study history, flashcard progress, and custom settings will be permanently and irreversibly purged from our Firestore databases and authentication records.
FikerLearn offers free diagnostic activities, but access to premium grade-level mock exams, comprehensive step-by-step explanations, and advanced simulator engines requires the purchase and activation of a digital access pass.
Activation Keys: Access passes are activated using unique alphanumeric Activation Keys. An Activation Key is tied to the grade-level materials purchased and unlocks those materials upon entry into the application. Once an Activation Key is registered to a user account, it is permanently consumed and cannot be reassigned or transferred.
Billing and Payments: Payment transactions are handled securely through certified payment gateways including Chapa. All transaction records, billing calculations, and local taxes are processed in accordance with Chapa's platform standards and Ethiopian financial regulations. We do not store or process credit/debit card numbers directly on our servers.
Refund Policy: Because digital Activation Keys and passes grant immediate access to proprietary educational materials and study prep questions upon activation, all purchases are non-refundable once unlocked or activated. Please verify that you purchase the correct key corresponding to your desired grade level.
Unless otherwise indicated, the Service is our proprietary property. All source code, databases, app functionality, software, user interface designs, audio, video, text, mock exam questions, solutions, flashcard contents, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us, and are protected by copyright, trademark, and other intellectual property laws in Ethiopia and internationally.
You are strictly prohibited from copying, reproducing, aggregating, republishing, uploading, posting, publicly displaying, encoding, translating, transmitting, distributing, selling, licensing, scraping, or otherwise exploiting any Content or Marks for any commercial purpose whatsoever without our express prior written permission.
The Service may allow you to submit, post, or display content, including usernames, profile avatars, classroom questions, study notes, and game room messages (collectively, "User-Generated Content" or "UGC").
Intermediary Liability & Neutrality: We act solely as a passive conduit and neutral platform host for user communications and UGC. We do not endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any UGC. You remain solely responsible for any content you upload or transmit.
License Grant: By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and adapt such content solely for operating, moderating, and improving the Service.
Prohibited Conduct & Moderation: You agree NOT to post, transmit, or share any UGC that:
We reserve the right, but not the obligation, to monitor, review, filter, or remove any UGC at any time without prior notice if we determine it violates these Terms or our Community Guidelines.
FikerLearn incorporates interactive Artificial Intelligence ("AI") features (such as Mr. Abel, Dr. Aster, and Mr. Solomon AI Tutors) powered by third-party enterprise machine learning APIs (including Google Gemini and OpenAI).
Zero-Training & Inference-Only Policy: Your prompts, study questions, and chat messages are transmitted to enterprise AI API endpoints solely in real time to generate educational explanations and answers. Your user inputs and personal conversations are NOT used to train, retrain, or improve third-party foundation models.
Educational Accuracy Disclaimer: While our AI prompts are engineered to strictly follow the Ethiopian national syllabus, generative AI systems may occasionally produce inaccurate, incomplete, or synthetic content ("hallucinations"). AI tutoring responses are designed for practice and conceptual explanation only. Students must always cross-reference explanations with their official Ministry of Education textbooks.
Student Safety: You must not enter sensitive personal data, financial information, passwords, or confidential records into the AI chat interface. We enforce automated filtering to block harmful, abusive, or non-educational prompts.
We respect the intellectual property rights of others and operate in compliance with the Digital Millennium Copyright Act (17 U.S.C. ยง 512) and the Ethiopian Copyright and Neighboring Rights Protection Proclamation No. 410/2004.
Designated Copyright Agent: If you believe that any material available on or through the Service infringes upon any copyright you own or control, please notify our Designated DMCA Agent:
Notice & Takedown Procedure: A valid copyright infringement notification must include:
Counter-Notification Procedure: If your content was removed as a result of a mistaken or misidentified DMCA notice, you may submit a written counter-notification containing your signature, identification of the removed material, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, and your consent to legal jurisdiction.
Repeat Infringer Policy: In accordance with statutory safe harbor rules, we maintain a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are found to be repeat copyright infringers.
These Terms remain in full force and effect while you use the Service. We reserve the right, in our sole discretion and without liability, to suspend or terminate your account, restrict your access, or block IP addresses for any violation of these Terms, unauthorized key distribution, cheating, or abusive behavior.
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
FIKERLEARN IS AN INDEPENDENT EDUCATIONAL PREPARATION SIMULATOR. WE DO NOT GUARANTEE THAT ANY STUDENT WILL PASS AN EXAM OR ATTAIN A SPECIFIC SCORE ON ANY OFFICIAL NATIONAL OR REGIONAL EXAM (MINISTRY OR ESSLCE).
IN NO EVENT SHALL ABEL SOLOMON ASFAW OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA OR REVENUE) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR PARTICIPATE IN A CLASS ACTION.
A. Informal Good-Faith Negotiation: Before initiating any formal legal proceeding or arbitration, you and we agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service informally for a minimum period of thirty (30) days. The informal negotiation begins upon receipt of a written notice containing your full name, account email, contact details, and a clear description of the claim sent to learnenglishwithabel@gmail.com.
B. Mandatory Binding Arbitration: If the dispute is not resolved through informal negotiations within thirty (30) days, all remaining disputes, claims, or controversies shall be resolved by final and binding individual arbitration administered by an established international or institutional arbitration body (or the Addis Ababa Chamber of Commerce & Sectoral Associations Arbitration Institute) under its commercial arbitration rules. The substantive laws of the Federal Democratic Republic of Ethiopia shall govern these Terms without regard to conflict of laws principles. The seat and venue of the arbitration shall be Addis Ababa, Ethiopia, and the proceedings shall be conducted in English or Amharic.
C. CLASS ACTION & JURY TRIAL WAIVER: YOU AND WE AGREE THAT ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. YOU EXPRESSLY WAIVE ANY RIGHT TO A TRIAL BY JURY.
D. Small Claims Court Exception: Notwithstanding the above arbitration requirement, either party may bring an individual claim in a small claims court of competent jurisdiction within Addis Ababa, Ethiopia, provided the claim qualifies for small claims court jurisdiction and proceeds solely on an individual, non-class basis.
E. 30-Day Right to Opt Out: You have the right to opt out of the binding arbitration and class action waiver provisions of this Section 12 by sending a written opt-out notice within thirty (30) days of first registering your account. The notice must include your full legal name, account email address, and a clear statement declaring your opt-out request, emailed to learnenglishwithabel@gmail.com with the subject line "Arbitration Opt-Out". If you opt out, all other sections of these Terms will continue to apply.
